Peru Passes Environmental Enforcement Law / Perú aprobó ley de fiscalización ambiental

The Peruvian Congress has approved the Law of the National System of Environmental Assessment and Control (Sistema Nacional de Evaluación y Fiscalización Ambiental – SINEFA), which aims to ensure compliance with environmental laws.
At the heart of the SINEFA is the Environmental Evaluation and Control Organism (Organismo de Evaluación y Fiscalización Ambiental – OFEA) created last year along with the Ministry, but until now was not given the tools it needed to fulfill its mandate. OFEA, a dependency of the Environment Ministry (Minam), will not set environmental standards, but rather monitor and evaluate compliance (including that of public entities at the national, regional and local levels), enforce the standards and sanction firms that violate them.
Among OFEA’s powers are unannounced inspection visits, during which OFEA officials can do any testing or sampling, videotaping or photographing (or otherwise documenting), or record-checking (including checking computer records) that they deem necessary to check for environmental compliance. Among the precautionary measures it is empowered to take are halting or restricting an activity deemed to be violating norms, or temporary closure of a facility. Among its corrective powers are permanent closure of an offending facility and ordering restoration, rehabilitation or reparation for environmental damages.

CONGRESO APROBÓ LEY DEL SISTEMA NACIONAL DE EVALUACIÓN Y FISCALIZACIÓN AMBIENTAL
La Comisión Permanente del Congreso de la República aprobó el martes último la Ley del Sistema Nacional de Evaluación y Fiscalización Ambiental (SINEFA), que tiene por finalidad asegurar el cumplimiento de la legislación ambiental, por parte de todas las personas naturales o jurídicas, afirmó el ministro del Ambiente, Dr. Antonio Brack.
“El nuevo Organismo de Evaluación y Fiscalización Ambiental (OEFA) que estará a cargo del sistema, será el ente fiscalizador ambiental responsable de asegurar que se cumplan los estándares ambientales, los límites máximos permisibles de emisiones, pero no es un organismo regulador, sino fiscalizador y sancionador a las empresas que infrinjan los estándares ambientales”, recordó el titular del sector Ambiente.
Por su parte, durante el debate congresal, la congresista Fabiola Morales dijo que con esta ley se da un paso trascendental para poner en práctica la Ley General del Ambiente. “El Ministerio del Ambiente se creó en un ámbito en que había que dar una respuesta política, sin embargo, no hubo la suficiente disposición para darle instrumentos tan importantes como el presupuesto. El ministro Brack tuvo que viajar a Europa para hacer realidad lo que es un Ministerio del Ambiente bien llevado”, afirmó la legisladora.
Como se recuerda, el OEFA creado mediante -Decreto Legislativo Nº 1013 del 14 de mayo de 2008, ya cuenta con un reglamento de organización y funciones, debiendo asumir las labores de fiscalización y supervisión ambiental. Es un organismo adscrito al Ministerio del Ambiente, y cuenta actualmente con la aprobación de un presupuesto de 5 millones de soles.
