Computer Take-Back in Rio de Janeiro / A Lei Sobre E-lixo do Municipio de Rio de Janeiro

Last week the Municipality of Rio de Janeiro (MRJ) (population 6 million) became the first major Brazilian city to adopt an e-waste law. The law is rather short and simple. It requires manufacturers and suppliers of computers to receive in their offices, branches or headquarters in the City “obsolete” computers discarded by consumers. The Law defines “computers” to include the CPU, monitor, keyboard, mouse and printer.
The new Law says only that the end-of-life computers and peripherals are to be received for recycling or reclamation (refurbishment for new uses), but otherwise is silent about the fate of the collected equipment.
Infractions of the law will be subject to the administrative penalties listed in the environment chapter of MRJ’s Organic Law. What are they? There are five options:
- daily fines;
- denial of license for the siting and functioning of another establishment involving the same title holder;
- loss, restriction or denial of incentives and fiscal benefits or credits of any nature;
- temporary suspension of the establishment’s activities;
- denial of renewal, or cancellation of previously granted license, for siting and functioning of the offending establishment, and its closure.

Na semana passada, o Municipio do Rio de Janeiro (MRJ) (população 6 milhões) se tornou a primeira cidade brasileira a adotar uma lei sobre e-lixo. A Lei é bastante curta e simples. Ela obriga os fabricantes e fornecedores de computadores a receber em suas representações, filiais ou matrizes os computadores “obsoletos” decartados pelo consumidor. A Lei define “computador” incluir a PCU (unidade central de processamento), o monitor, o teclado, o “mouse” e a impressora.
A nova Lei diz apenas que esses computadores e periféricos ao fim-de-vida devem ser recebidos para reaproveitamento ou reciclagem, mas alem disso não diz nada sobre o destino do material coletado.
As infrações da Lei estarão sujeitos às sanções administrativas previstas no capítulo sobre o meio ambiente da Lei Orgânica do MRJ. Quais são eles? Há cinco opções:
- multa diária;
- negativa de licença para localização e funcionamento de outro estabelecimento pertencente à mesma pessoa titular;
- perda, restrição ou negativa de concessão de incentivos e benefícios fiscais ou creditícios de qualquer espécie concedidos pelo Poder Público;
- suspensão temporária da atividade do estabelecimento;
- negativa de renovação de licença para localização e funcionamento do estabelecimento, ou cassação da licença anteriormente concedida e fechamento do estabelecimento.
